The instrument is a Special Act, Chapter 71-575, and the county records that this Special Act was incorporated in the Broward County Charter by public referendum as of 9 March 1976. So the arrangement is not an administrative convenience. It was voted on.

What that Act did was make the code countywide. The county writes that the code shall apply to all municipalities and unincorporated areas of Broward County, Florida, and that it shall apply countywide in both incorporated and unincorporated areas to all new buildings and structures, both private and public, and to all operations, additions and repairs in any new or existing building or structure.

The certification power is the sharp end. A department that the Board does not certify must use architects or engineers, or professional architectural or consulting engineering firms, in place of the officers it could not qualify. In other words the Board does not merely advise a city building department. It decides whether that department may staff itself in the ordinary way at all.

The plumbing officer gets a section of their own. To be eligible for appointment as a chief plumbing inspector, the person shall be certified as required by the county certification board as a plumbing plans examiner and as a plumbing inspector, with engineers exempt from that certification, and the code then adds that such person shall be certified by the Board of Rules and Appeals as well. Two certifications, for one appointment.

The Board also hears appeals against decisions made by building and fire code officials, considers proposed amendments to the Florida Building and Fire Prevention codes, and renders formal interpretations on the precise meaning of code sections in dispute. The small end reads as follows. No permit shall be required for general maintenance or repairs which do not change the occupancy and the value of which does not exceed fifteen hundred dollars in labour and material, as determined by the building official. A large restaurant fit out, a small apartment building or a serious commercial refit can pass two hundred and fifty fixture units without approaching the dollar figure, and the engineering requirement arrives regardless. Ask which of the two triggers applies before you budget the design.

Code editions change on their own schedule and local amendments are republished with them, so treat these as the shape of the rule rather than as this week version. The right move on any real job is to ask the building department for the edition currently in force at your address and the amendments that go with it.
