Everything after that point is yours to build. So the public work stops at the kerb and the private work starts there, with a separate permit and a separate trade.

The sewer side runs on a similar split but with an extra step at the front. Before connecting to the city sewer system, applicants must apply for an encroachment permit. That last card is worth pausing on because it is the far end of a spectrum this project has now measured three times, and each time the answer was different. It also explains why the phone call at the start of a blockage here is not the same phone call it would be one city over.

The city is explicit about the order of operations too: it states that it will check the sewer main if a plumber or drain cleaning service verifies that the main is at fault. In Fremont, immediately to the south, the sanitary district inspects its own main free of charge before anybody pays for anything. In Hayward the private trade goes first and the city follows. Neither is wrong, but they are opposite instructions and it is worth knowing which city you are standing in.

How Far the Public Purse Reaches Down a Sewer Lateral

Hayward states its position without any hedging. The city is responsible for maintaining city owned sewer facilities located in the public streets or easements, and the city is not responsible for maintaining private sewer laterals. The sewer customer is responsible for maintaining and repairing the private lateral, which the city defines as the portion on private property and the portion under the sidewalk and the street, up to and including where the lateral connects to the public system.

Its municipal code says the same thing in fewer words, and the city quotes it in its own maintenance handbook: maintenance of the building sewer shall be the responsibility of the owner of the property served.

Compare that with the two other answers this site has recorded in the same week. Boerne, Texas owns and maintains the lateral from its main as far as your cleanout, so the public purse covers the outdoor half. Fremont leaves the whole lateral with the householder including the run beneath the street. Hayward goes one word further than Fremont, because the words up to and including put the joint itself on your side of the line.

The city handbook is also unusually candid about why laterals fail, and it is worth repeating because it changes what you ask a plumber to look at. The city says the damage results not from the force of protruding tree roots but from old, worn laterals that have been improperly maintained: a slight crack opens at a pipe joint, the crack leaks moisture, the moisture attracts roots, and the roots then block the pipe. Roots are the symptom. The joint is the fault.

One practical instruction from the city that has nothing to do with pipe. It asks residents not to use its general online reporting tool for sewer issues, because doing so will delay the response, and to telephone instead. A city publishing the limits of its own app is rare, and during an overflow it is the most useful sentence it has written.

Three more layout rules from the same specification are worth carrying into any job. Sewer cleanouts must be installed on each lateral at the connection with the building drain, at any change in alignment, and at uniform intervals not exceeding a hundred feet. Manholes go in the main at any change of direction or grade, at intervals not exceeding four hundred feet, and at the upstream end of the pipeline. And where a lateral is the same size as the sewer line it is joining, the connection must be made with a manhole rather than a simple tie in.

Two rules govern where a water meter may physically sit, and both exist because of vehicles. Meters and services must be a minimum of two feet from the top of driveway flares, and the city states flatly that water meters shall not be located in the driveway. The city standard even names the make of lid it will accept, which we are not going to reproduce here, but it is a reminder that the meter box is a city component to a city specification even though it sits on the edge of your property.

The cleanout spacing rule is the one with the most day to day value. A lateral with correctly placed cleanouts is a lateral that can be surveyed and cleared without excavation, which is the difference between a drain cleaning visit and a dig. The fault is named after this city and it runs through it. The United States Geological Survey describes the Hayward Fault as a major earthquake fault running for nearly forty five miles through the East Bay, and as a right lateral strike slip fault, meaning that the motion along it is mainly horizontal.

The part that matters for buried pipe is not the earthquake. It is that this fault does not wait for one. USGS states that the San Francisco Bay Area is one of the few places in the world where faults creep, that is, where the fault slip is slow and continuous and does not occur as the result of a large earthquake, and that the Hayward Fault is actively moving year by year, unlike the San Andreas which is locked between major events.

USGS puts the creep at an average of about one fifth of an inch, five millimetres, per year, while noting in the same breath that it occurs at different rates in different locations and can vary significantly from one year to the next. We quote that average because it is what the source we read publishes, and we are not going to multiply it by a number of years to produce a figure of our own.

What USGS measures it on tells you the rest. Its catalogue of creep locations is a catalogue of sidewalk cracks, offset street curbs and cracked building foundations.
