Commercial Plumbing Los Angeles: The City Exempts Small Restaurants From Its Wastewater Permit, Until One Blocks a Sewer
Most cities that regulate what businesses put into a sewer do it by category. You are a food business, therefore you are permitted. Los Angeles does something more unusual and more interesting, and it is worth understanding before you sign a lease.
Here, an industrial wastewater permit is required of industrial facilities and certain commercial facilities, and the city then publishes a short list of discharges that do not need one at all. A restaurant seating fewer than 150 people is on that list.
Then there is a footnote. Restaurants, regardless of seating capacity, which cause undue maintenance or stoppage of the sewer system will be required to obtain a permit and install pretreatment.
So the exemption is real, and it is also conditional on nothing going wrong. A ninety seat kitchen is outside the regime right up until the morning it is not, and the event that moves it inside is a blockage rather than an inspection. This page is about that boundary, the other three thresholds beside it, and the second regime that catches a Los Angeles building for what is installed in it rather than for what leaves it.

Two Cities, One Question, Opposite Defaults
We have now read two large Californian cities on the same subject and they have arranged themselves in exactly opposite directions. Setting them side by side is more useful than either on its own, because it shows that this is a policy choice rather than a technical necessity.
San Diego permits every food service establishment in the city, up front, as a condition of trading. Its programme has run since 1989, it plan checks the equipment before a business opens, and the permit is the starting point.
Los Angeles exempts the small ones. Under the Industrial Waste Control Ordinance a restaurant below 150 seats does not need an industrial wastewater permit, and the city's own guidance says so plainly. The permit arrives afterwards, as a consequence, and the trigger is causing undue maintenance or a stoppage.
One city buys certainty in advance and charges everybody for it. The other spends nothing on the businesses that never cause a problem and reaches for the paperwork when one does. Neither is obviously right, but they produce completely different incentives for the operator.
Under the Los Angeles arrangement, a small kitchen has no compliance obligation and therefore no compliance record either. There is no inspection history, no plan check on file and no documented equipment standard, which means the first formal engagement with the city is likely to happen on the worst day, in the least favourable posture, with the requirement to install pretreatment arriving as an instruction rather than as a plan.
The practical reading for an operator under 150 seats is therefore not that the rules do not apply. It is that the rules are dormant, that you are the only person maintaining the evidence that they should stay dormant, and that the cheapest version of this regime is the one you never formally enter.
Six Thresholds in the Los Angeles Sewer Rules, Sorted by the Unit They Are Measured In
This grid sorts by unit of measure, which sounds pedantic until you notice that every threshold in this regime is a different physical quantity. There is no single number that tells you where you stand. There are six, and they are in six different currencies.
Seats
Restaurants with a seating capacity of less than 150 are listed as not requiring an industrial wastewater permit. A furniture decision, made by an architect, is doing regulatory work.
Tons of cooling
Bleed off or blowdown from cooling towers, evaporative condensers or other recirculating water devices with a rated capacity of 25 tons or less is exempt. The unit is refrigeration capacity, not water.
Pounds of laundry
Self service laundries with washing machines of 20 pounds maximum capacity are exempt, with a further allowance that an individual laundry may have a maximum of two machines at up to 50 pounds.
Gallons per day
Establishments where the industrial wastewater discharge is less than 200 gallons per day, and pretreatment is not required, are exempt. Two hundred gallons is a small number for a commercial premises.
Gallons per day, again, much larger
At the other end, a discharger of 25,000 gallons or more per day of process wastewater is defined as a Significant Industrial User, with more stringent requirements than other businesses.
Milligrams per litre
And once you are in, the numbers change currency again. The city publishes instantaneous maximum concentrations for a list of pollutants, plus a pH range, as values not to be exceeded at any time.
Cards one to four are exit doors and cards five and six are the rooms you land in. The reason the mixed units matter is practical: a business can be well under one threshold and well over another without ever having compared them, because nothing on a lease, a menu or a mechanical schedule presents them together.
If You Are In
Three Tiers, and the Bottom One Contains Your Dentist
A permit is not a single thing. The city sorts holders into tiers, and the tier decides how much of your week the regime consumes.
A Significant Industrial User is defined three ways, and meeting any one of them is enough: being subject to federal categorical pretreatment standards, discharging 25,000 gallons or more a day of process wastewater, or being designated as having a reasonable potential to adversely affect operation of the treatment plants. That last one is a judgement rather than a measurement, and it is the city's to make.
Significant users are then split again. Those subject to federal discharge limitations developed by the Environmental Protection Agency are Categorical Industrial Users and are also subject to the city's local limits. All other significant users are non-categorical and are subject only to the local limits.
Everybody else with a permit is a Local Industrial User, subject only to local limits and with lesser requirements. The city's own examples of that tier are worth reading slowly: automotive repair and maintenance shops, laboratories, medical and dental offices, and restaurants. A dental practice is on the same list as a metal finisher, in a lower tier.
Two administrative details catch people out. Significant user permits have a maximum duration of three years from initial issuance or reissuance, and applications for renewal must be filed at least ninety days before expiry. And permits are not transferable: whenever ownership of a business changes, the new company must obtain a new permit rather than inherit one.
A Second Regime Catches the Building for What Is Installed in It
Everything above regulates what leaves your premises. Los Angeles runs a separate set of requirements about what is fitted inside it, and a commercial operator can be entirely outside the wastewater regime and squarely inside this one.
The High Efficiency Plumbing Fixture Ordinance requires water using fixtures to meet water efficiency requirements when newly installed, replaced or retrofitted. The utility names cooling towers, toilets, showerheads, urinals, faucets and dishwashers, and states that it applies both to construction of new buildings and to the retrofit or renovation of existing buildings in the city.
Note what is first on that list. Cooling towers appear in both regimes, under two different departments, measured two different ways: by refrigeration tonnage for the wastewater exemption, and by efficiency standard for the fixture ordinance. A mechanical upgrade can therefore move you in one regime while being driven by the other.
Alongside it sits the Citywide Water Efficiency Standards Ordinance, which amends the building regulations to bring mandatory indoor and outdoor water measures into the city's green building and plumbing codes, and applies to new buildings and to additions or alterations to existing ones.
And then the one that lands at the worst moment. The city states that all residential and non-residential real property sold in Los Angeles must comply with a retrofit on resale ordinance requiring owners to upgrade indoor water using devices to water efficient models prior to the close of escrow. Commercial property is not exempt from that.
Anybody who has read the main Los Angeles city page will recognise the shape. That page sets out the seismic gas shutoff valve ordinance, which is also triggered by sale. This city has at least two separate plumbing conditions attached to selling a building, they sit in different ordinances, and neither of them announces itself until an escrow timeline is already running.
Detection and Consequence
The City Goes Looking, and It Names What Bad Discharges Do to Pipe
The monitoring programme is not purely reactive and the division describes three distinct ways it finds things. Routine facility inspections and sampling at permitted premises are the first. The other two are the interesting ones.
Inspectors conduct surveillance monitoring at sewer maintenance holes, which puts the sampling point downstream of the building rather than inside it. And they inspect targeted areas of the city specifically to inventory industrial users that require permits, which is an active search for businesses that are in the regime without knowing it.
The city is also unusually direct about physical consequences, in a passage that is worth quoting for anybody who thinks of discharge limits as paperwork. Illegal discharge to the sewer of regulated or prohibited substances, it states, can result in treatment plant upsets, poor quality of biosolids, eroded pipes, exploding sewer lines and noxious fumes.
Eroded pipes and exploding sewer lines are plumbing outcomes, not regulatory ones. They happen to somebody's building, and often not to the building that caused them.
Where compliance does not follow, the division runs an enforcement response plan with actions ranging from notices of violation and administrative orders through permit suspension and revocation to termination of sewer or water service, alongside civil or criminal prosecution. The stated advice to a business receiving a notice is straightforward and, we think, correct: understand the problem, ask questions, and work with the division rather than around it.
The City Disagrees With Itself Twice, and We Are Printing Both
Reading two City of Los Angeles publications side by side turned up two figures that should be the same and are not. Neither is a small discrepancy and neither is ours to settle, so both are set out here as read.

The first pair may simply be measuring different things, collection against treatment, or may be documents written years apart. The second pair is harder to wave away, because both are describing the same assumption about the same premises, and a three percentage point difference applied to a large water account is real money.
We are not going to pick a winner. What we would say to any operator affected by it is that the assumption is an assumption, and both documents describe routes away from it. The industrial guide notes that a facility may submit a water balance worksheet for verification, or use data from a flow meter at the discharge point if one is present. Measurement beats a percentage, and if the percentage is expensive enough the meter pays for itself.
The Hard Floor
Two Kinds of Limit, and One of Them Has No Number at All
Businesses in the regime face limits of two quite different types and they behave differently.
The first type is numerical. The city publishes local limits as instantaneous maximum concentrations in milligrams per litre, established specifically to protect its own treatment plants and applied to all types of industry, alongside a permitted pH range. They cover metals, cyanide, dissolved sulphides and dispersed oil and grease, and the city states they are reviewed on an ongoing basis. Federal limits apply on top of these for facilities with federally regulated processes, and can be more stringent.
We have deliberately not reproduced the numbers. They are published, they are reviewed, and a concentration limit copied onto a web page and read two years later is exactly the sort of figure a laboratory result gets checked against. Take them from the ordinance or from your own permit, which is where they are binding.
The second type has no number. The Industrial Waste Control Ordinance and the federal prohibitions contain a list of wastes that must not be discharged to the sewer in any amount at all. No concentration, no dilution argument, no allowance. That distinction matters operationally, because a business that manages its numerical limits by dilution has understood half the rules and is exposed on the other half.
Reporting obligations sit alongside both. Some facilities must periodically sample, monitor and submit reports, and the city requires notification of any change in waste strength or flow as well as any accidental discharge of prohibited or regulated material.

Who is exempt from the wastewater permit and who stops being exempt, how the city finds unpermitted businesses, and the second regime that catches your fixtures.
The city’s stated exemption is restaurants with a seating capacity of less than 150. It comes with an explicit footnote: restaurants, regardless of seating capacity, which cause undue maintenance or stoppage of the sewer system will be required to obtain a permit and install pretreatment. So the exemption holds while nothing goes wrong, and the division should be contacted to determine whether a permit is required rather than assumed either way.
Three further categories are listed. Bleed off or blowdown from cooling towers, evaporative condensers or other recirculating water devices with a rated capacity of 25 tons or less. No, and the city says so directly. Building permits, plumbing permits and sewer connection permits do not constitute industrial wastewater permits and must be obtained separately. They are issued by different parts of the Department of Public Works for different purposes, and holding one tells you nothing about whether you need another.
The definition is broader than the word suggests. Industrial wastewater is defined as any wastewater generated from any manufacturing, processing, institutional, commercial or agricultural operation, or any operation that discharges other than domestic or sanitary wastewater. The Bureau of Engineering’s permit material makes the point even more sharply, noting that wastewater from household type operations including dishwashing, laundry and car washing, when performed at commercial establishments, is considered industrial wastewater.
No. The city states that industrial wastewater permits are not transferable from one company or person to another, and that whenever a change in ownership of a business occurs the new company must obtain a new permit. That is worth building into a transaction timetable rather than discovering after completion.

There are several and we are deliberately not quoting current amounts. The structure is a permit application fee, a quarterly inspection and control fee set by an assigned class of which the city describes six, an additional fee for significant industrial users divided into six groups, and a quality surcharge fee where biochemical oxygen demand or suspended solids concentrations exceed those typical of domestic sewage. The amounts printed in the city’s own guide carry a date several years old, so the shape is reliable and the numbers are not. Get current figures from the division.
The city publishes several, and they are worth reading because most are about measurement rather than negotiation. Because several charges are based on metered water, conserving and recycling reduces them directly. Where you disagree with the city’s assigned strength values, you may self monitor and apply for a reduced surcharge if independent laboratory analysis shows your actual values are lower. And where discharge concentrations sit below the city’s stated baselines there is a low strength sewer service charge option, though the city warns it carries its own obligations and needs careful consideration.

Two things in the source were read and deliberately not reproduced. The local limits table is published as specific concentrations and is not copied here, because a limit read off a web page two years later is exactly the number a laboratory result would be wrongly checked against. And the quality surcharge fee formula, which the city publishes in full with its coefficients and baselines, is named but not reproduced, for the same reason multiplied by the risk of a transcription error.
Fee amounts are described structurally and no current figure is quoted. The city's own guide dates its application fee to a year well before this page was written, and the ranges beside it carry no date at all.
