Plumber Cumming GA: Here, Sewer Capacity Is Part of the Deed

Most towns treat a sewer connection as a service you apply for. Cumming treats the right to discharge into its sewer as a property interest that is bought, paid for in full before a shovel moves, recorded at the county courthouse and attached to the land.

The City states it plainly. The sale of sewer capacity is an appurtenance to, touches and concerns, and benefits the property, and the capacity runs with the property and cannot be sold or assigned to any other property without the express prior written consent of the City.

That single sentence changes what due diligence looks like on a Cumming parcel, what a developer is actually buying, and what a household on a septic tank is up against when it asks to come off it. You Do Not Apply for Sewer Here. You Buy It, and It Gets Recorded.

The City publishes the price and the arithmetic. Sewer capacity inside the Water and Sewer Service Area costs 30 dollars per gallon per day. Residential capacity is worked out at 250 gallons per day per unit, so the published example is a straightforward multiplication: number of units, times 250, times 30 dollars, giving 7,500 dollars per unit.

Then come the conditions. The City requires property owners who wish to reserve capacity to pay 100 per cent of the fee up front before any construction begins, and states that no capacity is guaranteed until payment in full is received. Capacity is currently limited and is assigned to properties case by case by the Mayor and Council.

And then the part that makes this different in kind rather than in degree. The purchase agreement is not effective until it has been signed by all parties, recorded on the real estate records of the Clerk of Superior Court of Forsyth County, and filed with the utility after recording.

A recorded instrument that touches and concerns the land is not a receipt. It is an interest in the property, and it behaves like one.

What that means in practice, for four different readers

Read the row that describes you

  • Buying a Cumming parcel. Ask whether sewer capacity has been purchased for it and whether the agreement was recorded. The City itself points readers at the Forsyth County Clerk of Court records for recorded sewer capacity purchase agreements, which tells you that is where the answer lives.
  • Selling part of a parcel. Capacity bought for a whole site does not follow a piece of it automatically. The City publishes a separate Sewer Capacity Assignment Document for assigning a portion to an out-lot, and the transfer needs express prior written City consent.
  • On septic and hoping to connect. The City answers this bluntly. Sewer is available to a limited number of customers and may not be available in your area, and where it is, the connection may be gravity or may require a grinder pump. Ring the utility before you price anything.
  • Quoting the work. A capacity purchase is not a plumbing cost and should not be buried inside a plumbing quote. It is a separate transaction with the City, paid before construction, with its own paperwork including a metes and bounds legal description, a perimeter survey, the owner signature and proof of ownership.
What we will not state. We are not quoting a current water rate, sewer rate or garbage rate for Cumming. The City publishes a fee structure adopted in February 2022, effective from April 2023, with annual increases scheduled through 2027, which means any number we printed would be a snapshot of a moving schedule. The 30 dollars per gallon per day figure is stated because the City publishes it as the capacity price on the capacity page itself, but confirm it before you rely on it.

Three Approved Pumps, by Manufacturer and Model Number

Low pressure sewer is not unusual in itself. What a household needs from a utility that uses it is specificity, and Cumming gives more of it than almost anywhere we have read. Our Port St Lucie page covers how these systems work in general, so this section sticks to the parts that are local.

The City names the allowable progressive cavity sewer grinder pump brands and models: E/One DH071, Flygt Xylem MF 3068.175 and Keen KPCG-21SL. That is a short list with part numbers on it, which is a very different thing from a general specification. If a quote you are given names a fourth pump, that is a question to ask before the work starts, not after.

The ownership split is equally clear. Each homeowner purchases and installs an individual grinder pump and connects the pump service line onto the City owned force main at the street right of way. The City owns and operates the common force main inside the right of way. The homeowner owns and operates the service line and the grinder pump itself.

The City also states what it cost. The total to purchase sewer capacity and install a grinder pump was approximately 15,000 dollars as of June 2020. We are repeating that with its date attached and nothing else, because it is six years old and the capacity price alone has a scheduled increase running through 2027 behind it.

Things worth establishing before you commit

  • Whether your address is on gravity sewer or low pressure sewer. The City publishes a list of subdivisions and roadways where low pressure sewer is available, so the answer exists.
  • Which of the three approved pumps is being proposed, and that it is one of the three.
  • Who is responsible for the pump after installation. On this system it is you, not the City, which makes the warranty and the service arrangement part of the purchase decision.
  • Where the right of way boundary actually falls, because that is where your responsibility ends and the City force main begins.
  • Whether the pump will be running into a line that already has problems. A camera survey of the existing run is cheap next to a pump that fails against a blockage it was never going to clear.

The Town Answered a Drought With Engineering Rather Than Only Rules

The Georgia hub covers the water wars, the record low lake levels of the late 2000s and the efficiency rules the state wrote afterwards. That is the statewide half of the story and we are not telling it twice. Cumming is the local half, and it took a different route.

In the historic drought of 2007 the City 1979 intake pipe finished up well above the water, because the lake did not only drop, it receded from the shore. The City installed two temporary emergency pumps in the bed of the lake and used them to feed its 1979 and 1989 raw water pump stations.

The permanent answer was completed on 1 August 2009 at a cost of approximately 16 million dollars. The raw water intake facility can pump up to 105 million gallons a day out of Lake Lanier, and the invert of its 72 inch intake pipe sits in the bed of the lake at elevation 1020 feet above mean sea level. The City describes that as one of the deepest intakes on Lake Lanier and virtually drought-proof.

From there the water goes to a potable water production facility rated at 24 million gallons on a peak day, a conventional plant with a chemical feed system built in 2015 that doses alum, lime, sodium hypochlorite, a corrosion inhibiting phosphate, fluoride and polymers. Powdered activated carbon was added to the raw water in more recent years to deal with seasonal taste and odour.

None of that reaches a tap directly. It matters here for one reason. A household in this town that gets discoloured water in the autumn is usually seeing lake turnover rather than its own pipework, and the City says so: iron and manganese levels rise in Lake Lanier when the lake turns over in the fall, and the treatment process is modified with strong oxidants when it happens. Before you replate a fixture or blame a heater, check the season. If it persists past the turnover, then it is worth looking at the plumbing.

A prohibition with its reasoning attached

The City Refuses to Let Anyone Build a Private Treatment Plant, and Says Why

Plenty of municipalities have policies. Very few publish the argument behind one in language a resident can weigh, and this one is worth reading because the logic generalises.

The City states that it has been its policy for many years to deny requests from developers to install new private wastewater treatment facilities within its Water and Sewer Service Area. Its reason is that such facilities are generally owned and operated by a private individual or a corporation in business to make a profit, and that this is not in the community interest, especially after twenty to twenty five years of operation when equipment begins to wear out and needs replacing.

Then it asks the question directly. When these facilities cease to be a money making operation, who will foot the bill to repair or replace the system.

It also shows its working. The City bought the Lanier Beach South plant in 2004 and decommissioned it in 2015, removing its discharge pipe from Lake Lanier the same year. That plant was built in 1970, was rated at 38,000 gallons a day and had discharged treated effluent directly into the lake for over forty five years. The Habersham on Lanier plant, built in the early 1970s to serve four named developments and permitted for 110,000 gallons a day, was decommissioned in 2018 after roughly forty eight years, also discharging directly into the lake. The City states there are no more private facilities inside its service area.

For anyone buying into an older lakeside development anywhere, that is the shape of the risk in one paragraph. A private plant is a capital liability with a clock on it, and the clock is roughly a working generation long.

Two Date Rules That Sound Like One and Are Not

Our Marietta page already covers what it means when a Georgia utility completes a service line inventory and finds no lead, and Cumming is heading for the same answer, so we are keeping this short and pointing you there for the general case.

What is worth isolating here is that the City is running two exercises with two different date rules, and confusing them wastes everybody time.

The service line material survey targets homes constructed before 1990. The City reports it has investigated 927 of 5,358 such customer service lines and has so far found no lead, and it asks owners of pre-1990 homes to complete a survey with photographs.

The federal lead and copper sampling programme is narrower. Those samples, the City says, can only be taken from homes built after 1982 and before June 1988, because lead solder in the joints of copper pipe is the mechanism being tested for. Participation is voluntary, the draw must be cold water after at least six hours of standing, and the City notes its own corrosion control began in 1988.

Three Local Rules Where Only the Detail Is New

The leak adjustment. How a Georgia leak adjustment works in general is set out on our Alpharetta page for the county system next door, and we are not rewriting it. Three Cumming specifics are worth carrying. If the City notifies you of a leak, it is your responsibility to find and repair it within 30 days of being notified. An adjustment is limited to one every 24 months. And irrigation water consumption is not eligible for an adjustment at any time, which makes a leaking sprinkler system the most expensive leak on the property here.

The City also requires a receipt for parts or a paid bill from a licensed plumber with the request, and will accept a notarised letter describing the repair if you did the work yourself and have no receipt. Requests must be filed within 90 days of the first higher than normal bill, and are not available on developer, builder, apartment or master meter accounts, on delinquent accounts, or within 90 days of a certificate of occupancy on a new build.

The grease interceptor. Grease traps are on a great many pages of this site and the case for maintaining one does not need making again. The Cumming sizing rule is the part that is genuinely local, and it is a formula rather than a table. Each grease trap must allow for 15 gallons per seat, multiplied by the hours of operation divided by twelve, multiplied by a loading factor. The City worked example is a 200 seat establishment at 24 hours arriving at 6,000 gallons.

No single trap may be smaller than 1,000 gallons or larger than 3,000, so above that you install several. The City publishes a photograph of a neglected trap whose owner it fined 2,400 dollars.

Where the leaks actually are. The City runs a leak identification crew and periodically hires a contractor with listening equipment and leak correlators to sweep segments of the system. Its own conclusion from that work is the useful sentence: most of the time, leaks occur in privately owned water service lines that transport water from the meter to a home or business. That is an argument for treating an unexplained bill as a private side investigation first.

What the Utility Says It Runs

Cumming Utilities puts approximately 22,000 water meters in the ground and over 300 miles of water mains behind them, and describes a distribution and collection division that maintains hydrants, water and sewer lines, manholes and utility locates, clears easements and rights of way, repairs meters and jets and unclogs sewer pipes.

On the wastewater side it publishes a sixty year sequence rather than a single number. The City built the area first wastewater treatment facility, a five acre oxidation pond, in 1963. In 1991 it moved treatment to Bethelview Road as a 2 million gallon a day advanced water reclamation facility, expanded that to 3 million gallons in 1999, and rebuilt it between 2006 and 2008 at 8 million gallons a day for just over 30 million dollars. Treatment ends with ultraviolet disinfection and discharge into Big Creek.

One figure from that page is worth flagging as a claim rather than a fact. The City presents the plant cost as 30 million dollars divided by 8 million gallons a day, giving 3.75 dollars per gallon, and invites a comparison with others in the region. That is the City own framing of its own project and we are reporting it as such rather than endorsing the comparison.

There is also a septic charge published, which is unusual and useful if you are on a tank. The City charges 0.15 dollars per gallon to discharge a septic truck into the Bethelview Road facility, and puts a typical 2,000 gallon load at 300 dollars. All waste haulers must obtain a permit to discharge from the pretreatment coordinator, so a hauler working in Cumming should be able to say who permitted them.
